Legal Challenges Persist Surrounding OWP

WESTFIELD — New legal challenges continue to pile up around the One Westfield Place redevelopment project.

On Tuesday, during a regular meeting of the Westfield Town Council, Mayor Shelley Brindle announced that the Westfield Advocates For Responsible Development (an ad-hoc citizen’s group that has levied multiple lawsuits against the town, its planning board and multiple redevelopment entities) has filed a new appeal in state Superior Court.

“The court has ruled in the town’s favor all four times in challenges brought by the Advocates, with the judges affirming every time the integrity of our process and the [project’s] consistency with our Master Plan,” Mayor Brindle said, “It has always been [their intention] to cause delays, and perhaps they falsely believe that a new administration will somehow be able to disregard our legally-binding negotiated agreement when that is absolutely not the case.”

The Advocates initially filed suit earlier this year in regards to an amended agreement reached between the town and the project’s redevelopment entity, Streetworks (a division of Saks Global Properties and Investments). That suit was dismissed with prejudice in September.

“Unfortunately, the legal action by the Advocates does nothing but waste valuable town resources that must be devoted to defending these meritless cases,” Mayor Brindle said.

The town, meanwhile, has filed its own legal motion in an attempt to recoup approximately $79,610.00 worth of attorney’s fees that it says it has spent defending itself from “frivolous” lawsuits.

Despite ongoing legal complications, Mayor Brindle said Tuesday that the project is moving “full-steam ahead.”

In other Westfield news, the town’s new online parking permit system went live this week, Mayor Brindle saidTuesday, adding that the transition to a digital system was Daily permits for both the South Avenue and Watterson Street lots will still be sold in person through the end of this week, Town Administrator Jim Gildea said, but all sales will need to go through the ParkVANTAGE app going forward.

The new system also allows residents to join the annual permit waitlist and register multiple vehicles at one time. The opportunity to renew and pay for annual permits online will be made available in December.
